Naked Pools, LTD warrants to the original retail purchaser that the Naked Pools NKD-R Digital Control Unit and Oxidiser Electrode (“Unit”) will not fail or malfunction due to defects in materials or workmanship for a period of Four Years in accordance with this limited warranty.  The Naked Pools NKD-M Digital Control Unit and Oxidiser Electrode (“Unit”) is warranted for a period of Three Years in accordance with this limited warranty. This Unit is designed for use in domestic/residential swimming pools only, and the limited warranty is void if the Unit is installed in a commercial swimming pool. Keep your original purchase invoice and serial number in a safe place.

WARRANTY CLAIM PROCEDURE.

In the event of a warranty claim of a defect or malfunction covered under the provisions of this limited warranty, the original retail purchaser must notify, in writing, the retail dealer or Naked Pools Customer Service department within ten (10) days of the initial malfunction or discovery of defect. If the retail dealer does not provide support, then the purchaser should contact Naked Pools Customer Service department, via the web site, or provide written notice of the malfunction or defect at the address below. The retail purchaser must provide proof of original retail purchase, with their claim, for warranty validation and consideration. Upon notice of the warranty claim, the retail dealer or Naked Pools Customer Service department will work with the retail purchaser to troubleshoot and determine if the claimed malfunction or defect is a covered malfunction or defect under this limited warranty. This limited warranty covers parts only to repair or replace applicable components. In the event of a Unit replacement, the replacement Unit will carry the balance of the original Unit limited warranty from the original retail purchase date. This limited warranty is extended only to the original retail purchaser and is not transferable. This limited warranty becomes void upon the transfer of ownership of the Unit.

Defective Unit or components must be returned to Naked Pools or dealer as soon as the purchaser becomes aware of the defect.  Naked Pools will reimburse the original purchaser transport costs for the first 12 months. Transport costs for shipping the Unit or components to Naked Pools or the dealer for the following 36 months will be the sole responsibility of the purchaser. Naked Pools will cover the cost of return shipping back to the purchase. Neither Naked Pools nor the dealer shall be responsible for any goods damaged in transit.

If after examination the Unit or component is found to be defective it will be repaired or replaced free of charge (other than transport costs which will be borne by the purchaser). However, if upon inspection of the Unit it is determined that the malfunction or defect is not covered by this limited warranty, then the usual charges of the retail seller for repair or replacement will be made including all transport costs.

The maximum liability incurred by Naked Pools shall not in any case exceed the contract price for the Unit or the product parts or components thereof claimed to be defective.

Products sold by Naked Pools are designed for use with swimming pool water balanced in accordance with the Langelier Saturation Index with a pH range of 6.8-7.8. Copper levels should not exceed 0.7ppm and the TDS level should not exceed 3000ppm.

The manufacturer will not be held liable for damage caused by, but not limited to, corrosion, scaling or stress.

The following may void warranty:

  • Installation is carried out incorrectly by any person other than a person authorised by us to do so.
  • The Control Unit, Oxidizer Electrode or Ionizer Rods is serviced by any person other than a person authorised by us to do so.
  • The Control Unit is not protected from the elements.
  • The Control Unit is not operated in a position/area with good ventilation.
  • Water has been allowed to enter the Control Unit or Cable connections.
  • Run in a commercial installation unless a commercial model is purchased.
  • Insect infestation or penetration by dust, sand or other foreign particles inside the Control Unit.
  • Damage beyond our control.
  • Unit has been misused, neglected, damaged, repaired without authorization or altered in any way.

NAKED POOLS NEITHER ASSUMES NOR DO WE AUTHORIZE ANY OTHER PERSON TO ASSUME FOR US, ANY OTHER LIABILITY IN CONNECTION WITH THE SALE OF UNIT’S MANUFACTURED BY NAKED POOLS. THIS LIMITED WARRANTY SHALL BE THE EXCLUSIVE REMEDY AVAILABLE TO A PURCHASER AND NAKED POOLS SHALL NOT BE LIABLE FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM MISUSE OF THE UNIT OR CAUSED BY ANY DEFECT, FAILURE OR MALFUNCTION OF THE UNIT, WHETHER A CLAIM IS BASED UPON WARRANTY, CONTRACT, NEGLIGENCE OR OTHERWISE. SOME STATES DO NOT ALLOW THE EXCLUSION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THIS LIMITATION MAY NOT APPLY TO YOU.

TO THE EXTENT PERMITTED BY APPLICABLE LAW, THIS LIMITED WARRANTY SPECIFICALLY EXCLUDES ANY AND ALL IMPLIED WARRANTIES OF MERCHANTABILITY AND/OR FITNESS FOR A PARTICULAR PURPOSE, OTHERWISE ALL IMPLIED WARRANTIES ARE LIMITED IN DURATION TO TWO (2) YEARS FROM THE ORIGINAL DATE OF RETAIL PURCHASE. SOME STATES DO NOT ALLOW THE LIMITATION OF THE DURATION OF IMPLIED WARRANTIES, SO THIS LIMITATION MAY NOT APPLY TO YOU. THERE ARE NO OTHER WARRANTIES, EITHER EXPRESSED OR IMPLIED, OF ANY KIND OR NATURE WHICH EXTEND BEYOND THE DESCRIPTION ON THE FACE HEREOF. SOME STATES DO NOT ALLOW THE LIMITATIONS OF REMEDIES SO THESE LIMITATIONS MAY NOT APPLY TO YOU.
